Brian Rubenstein is a civil trial attorney who has been practicing law in Florida for over 17 years, including over 15 years with the firm. Mr. Rubenstein leads a practice group in the firm’s Tampa office of 20 employees.
Mr. Rubenstein has a great deal of experience trying cases involving a variety of areas of civil law. He defends employers against employment and labor law claims, from administrative proceedings through trial, including claims involving discrimination, retaliation, whistleblower, wage and hour, civil rights, breach of contract, negligent retention, negligent hiring, sexual harassment, non-compete agreements, trade secrets and intellectual property, FLSA, FMLA and NLRB and class actions.
Mr. Rubenstein’s litigation practice also focuses on premises liability claims, negligent security claims, automobile negligence claims, wrongful death claims, sexual assault and battery claims, products liability claims and infectious disease claims including Legionnaire’s Disease.
His litigation experience also includes the defense of claims against insurance brokers and agents, legal malpractice, accountants, claims under unfair debt collection statutes, under both federal and Florida state law, including numerous class actions, as well as claims involving housing discrimination and fair housing statutes, condominium associations, professional liability, directors and officers, errors and omissions, ERISA, commercial litigation, asbestos, products liability and nursing homes.
Mr. Rubenstein has a great deal of experience in education law, representing many preschools, K-12 schools, and colleges and universities throughout the state of Florida.
