Appellate Win

Michael Rosenberg and Adrianna de la Cruz-Muñoz of CSK’s Fort Lauderdale West office successfully defended an appeal brought by homeowners in their suit against a construction company and the owner, individually, alleging causes of action for tort-based claims as to the owner. At the trial court Daniel Levin of CSK’s West Palm Beach office obtained summary judgment in favor of the construction owner, arguing the Independent Tort Doctrine barred the homeowners’ action. On appeal, the homeowners argued that genuine issues of material facts remained, and that the independent tort doctrine did not apply. In affirming the final summary judgment, the Fourth District Court of Appeal rejected homeowners’ arguments. In addition to affirming the final judgment, the appellate court also conditionally granted entitlement to appellate attorney’s fees.
