Pensacola Partners Randy Rogers and Richard Fillmore obtained a full defense verdict in an auto accident case tried in Panama City.
Plaintiff claimed injuries to her c-spine which resulted in a 2 level fusion and in an aggravation of pre-existing headaches and dizziness. Plaintiff further claimed the aggravation of her pre-existing conditions led to a fall three months after the accident and resulted in a surgical repair of her ACL and meniscus. Plaintiff asked the jury for $1.3 million in closing despite a significant pre-accident history of the same conditions she claimed were the result of the accident. After approximately 2 hours of deliberation, the jury awarded the Plaintiff nothing.
