Orlando Partner Mike Merrill and Miami Partner Mike Brand obtained a complete defense verdict in an auto accident case in Orlando. Plaintiff was rear-ended in a collision so significant that it disabled the car which hit her. As a result of the accident, plaintiff had disc replacement surgery, was recommended for a subsequent fusion and claimed that the accident forced her into early retirement. The defense had no medical experts. Plaintiff’s counsel asked the jury for $7.5 million.
At trial, the defendant testified that he was not driving and had been called to the accident scene by a friend who asked him to take responsibility for driving as the friend did not have a valid license. After deliberating 3.5 hours, the jury returned a complete defense verdict.
