West Palm Beach partner Stephen Harber and Miami partner Robert Guinn obtained a complete defense verdict in a First Party case in Palm Beach County.
Plaintiff claimed that a covered event caused an opening to the building envelope that allowed rain water to enter the home, causing damage.
The defense presented testimony from an engineer that the rain water entered the home though an opening caused by wear and tear and not a sudden and accidental event.
This was a fairly heavily litigated case that would lead to plaintiff getting fees and costs had they won. The jury was out for 3 hours before returning a verdict for the defense.
