Defense Verdict for HOA in Orange County

Orlando Partner, Jeffrey Partlow and Associate, Savannah Duffy, obtained a complete defense verdict on behalf of a homeowners’ association (HOA) in Orange County. Plaintiff sent his HOA 142 separate typewritten records requests and claimed that they failed to comply with statutory requirements providing homeowners’ access to association’s records.  The HOA disputed Plaintiff’s claims and argued that it properly maintained its records and complied with the statutory requirements by providing Plaintiff reasonable access to all of its records on a monthly basis.

The dispute ended up with an 143-count complaint (and a 130-page verdict form after Jeff and Savannah were able to obtain summary judgment on some counts before trial).  Prior to trial, Plaintiff’s demands never came below 6-figures. The jury quickly returned a defense verdict.
