Favorable Verdict – Admitted Liability Case

Orlando Partners Monica Walker and Michael Merrill recently received a favorable trial result in an admitted liability case against Morgan & Morgan in Orange County.  The case involved a head-on collision at an intersection.

Plaintiff complained of injuries to her neck, low back, and left hamstring.  All of her doctors testified she sustained herniated discs at C4-5, C5-6, and L4-5, as well as an avulsion tear of the left hamstring.  She underwent multiple injections in her neck, low back, and left hamstring.  She eventually underwent cervical spine surgery and had recommendations for surgical repair of her left hamstring and low back.  The defense focused on similar injuries from a prior accident and argued the Plaintiff never fully recovered from her prior injuries.  Plaintiff boarded $292,000 in past medical bills and she asked for $1,800,000 during her closing arguments.

The jury returned a verdict of $286,000, which covered approximately 70% of the Plaintiff’s past and future medical bills.  However, they also found Plaintiff did not sustain a permanent injury which eliminated the claims for pain and suffering.
