Palm Beach Partner Ian Koven obtained a final summary judgment in a slip and fall claim in Miami-Dade County. Plaintiff allegedly slipped on a “dirty liquid substance” as he was walking up a driveway to an office building in the rain. Plaintiff underwent , anterior cervical discectomy and fusion as a result of the fall. Ultimately, the Court ruled that the Plaintiff could not prove how the alleged condition, if any, was created, what it was, who caused it, how long it existed, or that the Defendant was responsible.
