Ft. Lauderdale Partner, Jami Gursky, obtained final summary judgment in Palm Beach County Circuit Court on behalf of a Clinical Director and Licensed Clinical Social Worker who was alleged to have negligently treated and supervised a 24-year-old mother’s substance use disorder. Plaintiff claimed a higher level of care was required after 5 “major” relapses that were not addressed by the treatment team. The defense argued the Clinical Director, who began working at the treatment center 2 weeks before the client was administratively discharged, did not owe a duty, breach a duty, or contribute to the Plaintiff’s death. Summary judgment was awarded on all three independent grounds.
