Summary Judgment - Florida Whistleblower Act - West Palm Beach

West Palm Beach Partner Nicole Wall obtained a summary judgment in a state court case filed by a former employee of a medical practice for alleged violation of the Florida Whistleblower Act.

Plaintiff claimed that she was terminated because she complained about conduct by her employer constituting a violation of OSHA. Nicole successfully argued that the action did not constitute an OSHA violation, the plaintiff never complained that it did, and plaintiff was discharged solely as a result of poor job performance. The Court agreed and granted a complete summary judgment dismissing the action.
