Wrongful Death Medical Malpractice Defense Verdict

Tampa Partners, Dan Shapiro and M. Elizabeth Lanier secured a defense verdict in a Sarasota County wrongful death medical malpractice case.

The case involved a 50 year old woman who died four days after visiting Defendants’ primary care clinic for treatment of a chronic cough. Autopsy revealed that her death was caused by bilateral pulmonary emboli and a massive left pulmonary artery embolus.

The decedent’s husband claimed that all the warning signs were evident at the time of the her last visit, and that the treating physician’s assistant should have sent her to the emergency room, where she would have been diagnosed and treated for the condition that caused her untimely demise. Plaintiff asked the jury to award just over $17 million dollars.

The hard-fought 5 day trial ended in a complete defense verdict!
