CSK Orlando Partners, Ryan S. Sawyer and Scott Shelton obtained a favorable trial result after a four-day in-person jury trial in this premises liability case. This trial was one of the first in-person jury trials to take place in Florida since early 2020.
The two Plaintiffs alleged they were injured when their vehicle fell into a large hole in our client’s dirt and gravel parking lot. Plaintiffs, neither of whom had any documented history of prior cervical issues, each underwent extensive treatment, including fusions to their necks.
The Defense argued its actions were reasonable under the circumstances, including placing a large yellow cone next to the hole to warn patrons. The Defense also argued the Plaintiff-driver was comparatively negligent for failing to observe the warning cone and for driving in the parking lot at an unsafe speed.
After deliberating for approximately two hours, the jury returned a verdict finding the Plaintiffs mostly responsible.
