Miami Partners, Colin Riley and Michael Brand, recently obtained a great verdict in Fort Myers. Plaintiff alleged the decedent was improperly placed in the defendant’s Assisted Living Facility after her treating physician certified she was inappropriate for the facility and could not be cared for in an assisted living facility. Within 10 days of her admission, the decedent fell and fractured her hip. The jury awarded past medical bills of $17,500 but no pain and suffering. Additionally, due to an earlier arbitration award of $175,000 which the plaintiff rejected, the defense will be entitled to its fees and costs.
