Mark Tinker of CSK’s Tampa office obtained a dismissal of an appeal seeking to overturn the trial judge’s imposition of sanctions for the plaintiff’s failure to appear at a pre-trial conference. Mark established that the attempted appeal was one day too late because the trial court attempts at rehearing were unauthorized and therefore did not toll the time to appeal. Because the appeal was late, the district court had no jurisdiction to review the order and dismissed.
