Mark Tinker of CSK’s Tampa office obtained a reversal of a trial court order requiring an insurer to issue loss payment for a claim in which it made a timely and valid election to repair covered losses. The trial court found People’s Trust’s emergency mitigation repair provision to be invalid and unenforceable, but the Fourth District determined that it was both unambiguous and valid.
