Michael Rosenberg and Adrianna De La Cruz-Muñoz of CSK’s Fort Lauderdale West office successfully defended an appeal brought by homeowners in their suit against the condominium association. At the trial court, Blake Sando and Maria Vera of CSK’s Miami Office obtained the dismissal of an eleven count complaint on the basis of: (1) the expiration of the statute of limitations; (2) the application of the business judgment rule; (3) the failure to state a cause of action; and (4) mootness. The Third District Court of Appeal per curiam affirmed the trial court’s comprehensive sixteen-page order dismissing the homeowner’s second amended complaint. The Third District Court of Appeal unconditionally granted appellate attorney’s fees in favor of the condominium association.
