Miami Partner, George Hooker and Plantation Partner, Jose Campos recently secured a defense verdict in a jury trial for People’s Trust Insurance in Broward County. The case involved a third-party vendor placing a shrink wrap on a homeowner’s roof to allegedly protect the property from further damage as a result from Hurricane Irma. The services were after Hurricane Irma and after People’s Trust had offered a full roof replacement to the homeowners. Rather than allow for People’s Trust to replace the roof, the homeowners sued People’s Trust and assigned benefits to the Plaintiff to place the wrap on their roof.
After 45 minutes of deliberation, the jury returned a full defense verdict that the Plaintiff’s services were not reasonable nor necessary to protect the property, because the roof should have been replaced before Plaintiff’s services were rendered.
