Complete Defense Verdict - Breach Claim - Orange County

Fort Lauderdale East Partner, Jose Campos, and Orlando Partner, Scott Shelton, recently obtained a complete defense verdict in Orange County.

Plaintiff was a resident at Defendant’s apartment complex where he allegedly sustained respiratory issues due to documented toxic mold inside his unit. Plaintiff alleged various injuries as a result including the alteration of his voice which ruined his singing career. Plaintiff presented photographs and video of the subject mold and also called a board-certified infectious disease expert to testify.

During closing arguments, Plaintiff requested the jury award a significant amount of money. After approximately 40 minutes of deliberating, the jury returned a complete defense verdict finding it did not breach the terms of the lease. The defense did not call any witnesses including its retained expert and has an expired Proposal for Settlement which will entitle it to recover its fees and costs.
