Complete Defense Verdict - Commercial Easement -  Okaloosa County 

Pensacola partner Michael Kelly and Associate Kayla Ryan recently secured a complete defense verdict following a bench trial in Okaloosa County surrounding a commercial easement dispute.  

Plaintiffs sought injunctive relief and claimed they had the right to prevent Defendants from operating a restaurant on a beach parcel. Following two days of heated trial, the Court asked all parties to submit written closings. Following the conclusion of the evidence and submission of written closings, the Court considered the arguments and issues for nearly two months. The Court has now entered judgment in favor of Defendants on all issues; most specifically, finding that the commercial easement did not apply to the restaurant.
