Complete Defense Verdict - Hurricane Damage Claim - Miami-Dade County

Fort Lauderdale West Partner, Nicholas LeRoy, and Fort Lauderdale West Associate, Sofia Marescalco, recently obtained a complete defense verdict in Miami-Dade County.

The Plaintiffs claimed that Hurricane Irma caused damage to their roof and the interior of their property. The defense argued that the carrier was prejudiced in its investigation of the claim because of the Plaintiffs’ failure to provide prompt notice and the Plaintiffs’ failure to provide information, documents, and photographs to substantiate the loss which prejudiced the carrier in its ability to investigate Plaintiffs’ claim.

Following three days of trial, the jury received the case. The jury was out for approximately two hours before returning a complete defense verdict.
