West Palm Beach Partner Justin Sorel and Associate Jessica Extra obtained a Complete Defense Verdict in a binding arbitration on behalf of their client, a university. Plaintiff, a former student, alleged numerous causes of action relative to his student loans and negative credit reporting due to his failure to pay back his student loans, including violation of the Fair Credit Reporting Act, violations of the Fair Debt Collections Practices Act, negligence, gross negligence, breach of fiduciary duty, fraudulent misrepresentation, and intentional infliction of emotional distress. The defense was able to establish that Plaintiff received notification of the loan through email and/or mail, and through Plaintiff’s own admission, he either didn’t open or read the correspondence. The Arbitrator issued the defense verdict on all counts.
