Orlando Partner Michele Morales and Miami Associate Katrina Fernandez recently obtained a complete defense verdict in a negligence action following a 4-day jury trial in Indian River County.
The plaintiff, who was represented by a well-known plaintiff’s firm, sued a large national retailer for a slip and fall occurring in 2020. The case was complicated by the fact that the fall occurred between two associates who were stocking a cooler at the time of the accident, which the plaintiff argued was sufficient to establish constructive notice. Additionally, the employees wiped up the spill before taking pictures of the area, which the plaintiff argued constituted spoliation of evidence.
Plaintiff claimed nearly $800,000 in economic damages and nearly $2,000,000 in pain and suffering. After just 2 1/2 hours of deliberations, the jury returned a complete defense verdict in favor of our client.
