The sibling team of Orlando Partner Michele Morales and Tampa Partner Carlos Morales are back at it again! They recently received a complete defense verdict in Broward County. Plaintiff alleged that he was out-of-pocket $172,000 for repairs and consulting experts. He alleged that his condominium in Fort Lauderdale suffered from various forms of water intrusion since 2015 and that our client, the Condominium Association, was partially liable for his damages. Our co-defendant is the owner of the property.
Litigation commenced in in February 2018 and Plaintiff immediately sought injunctive relief. Fort Lauderdale Partner Peter Weinstein entered an appearance the night before the first hearing on that claim. We lost that motion, appealed, and the 4th DCA reversed.
Starting in 2020, we then enjoyed 13 evidentiary hearings and ultimately prevailed on the second motion for injunctive relief. The Plaintiff appealed again, and we prevailed again.
The recent jury verdict followed a 3.5-week trial on damages. The target was prevailing party attorney’s fees which the Plaintiff's accountant had previously testified exceeded 1.75 million. By the close of evidence that figure was not less than 3.2 million.
At trial, Plaintiff had 9 lawyers plus support personnel. During trial we had 3 depositions and two full day property inspections on newly reported and court permitted claims reported as reoccurrence leaks.
