Orlando Partners Ryan Sawyer and Scott Shelton recently received a complete defense verdict in Seminole County for underinsured motorist claim on behalf of a well-known insurance carrier where the policy limits were previously tendered but rejected.
The Plaintiff was rear-ended by another vehicle that was totaled as a result of the accident. She was treated at the emergency room the following day and eventually underwent two surgeries to her lower back. After her complaints did not resolve, her treating physician recommended a third surgery. Plaintiff boarded approximately $220,000 in past medical expenses and asked for well over $1 million during closing arguments. Defendant did not call any of its retained experts to testify.
After approximately one hour of deliberations, the jury returned a complete defense verdict finding that Defendant’s negligence (which was admitted) was not a legal cause of Plaintiff’s injuries. Defendant had an expired Proposal for Settlement which will allow it to recover its fees and costs.
