Defamation Suit Dismissed

West Palm Beach Associate Andrew Goodman achieved a significant victory by obtaining a Dismissal with Prejudice of a defamation suit. The Plaintiff had sued our client, who prepared an inspection report for a large home developer, citing defects in the Plaintiff’s construction of pickleball courts. Claiming financial and reputational losses, the Plaintiff sought an injunction against our client.

Mr. Goodman skillfully prepared a Motion to Dismiss, raising constitutional issues, including the client’s privilege to speak the truth. He also opposed the injunction as an illegal prior restraint of speech. The judge was receptive to Mr. Goodman’s arguments and granted the motion, albeit with leave to amend.

Following the hearing, the Plaintiff’s Counsel contacted Mr. Goodman, acknowledging the persuasive nature of his legal argument. They agreed to a Dismissal with Prejudice if our client would waive fees. Our client and its carrier, delighted with the complete victory, agreed. This resolution was achieved with no discovery, much to the carrier’s satisfaction.
