Tampa Associate Dallas Bright and Fort Lauderdale West Partner Greg Willis recently won a defense verdict in Pinellas County after a three-day auto accident trial.
The defendant was elderly and not able to attend trial, so the case was tried with no client at the defense table. The national plaintiff firm refused to allow the jury to be advised as to why the defendant was unable to attend trial. Due to defendant’s absence, liability was admitted. Both vehicles were a total loss in a serious intersectional collision.
Plaintiff was taken by EMS to a local hospital to receive conservative care, then was later advised that they would need ongoing treatment. Plaintiff asked for $400,000 in medicals and $1.5 million in pain and suffering. After an hour of deliberation, the jury awarded just $27,400 in past medicals.
