West Palm Beach Partners Stephanie Partlow and Barry Postman recently obtained a complete defense verdict in a nine plaintiff race discrimination case based out of Volusia County (Deland).
The Plaintiffs asserted that the CSK client (a nursing home and its consulting company) systematically discriminated against African American employees by allowing racial epithets to be used on a regular basis and for retaliating against the Plaintiffs when they complained of racial harassment. The lowest pre-trial demand made by the Plaintiffs was $2.9 million. The highest offer that was given prior to trial was $800,000 with an assignment of the right to pursue any other insurance the Plaintiffs were able to obtain. The attorney for the Plaintiffs thought this offer was insulting and refused to further negotiate. The Plaintiffs asked for over $13 million dollars from the jury along with a request for punitive damages.
After deliberating for two days, the jury returned a complete defense verdict.
