Orlando Partner Jeffrey Partlow and Associate Carita Skinner obtained a defense verdict on behalf of three condominium board members in Volusia County.
Plaintiff operated a hotel within a condominium in Daytona Beach Shores and brought claims for tortious interference and breach of fiduciary duty against three of the condominium association’s board of directors based on condominium owners renting their units outside the hotel and not taking action to enforce the covenants.
Two board members obtained summary judgment on the tortious interference claims before trial, and the third board member won on directed verdict. Only the breach of fiduciary duty claims were submitted to the jury. After more than 3 hours of deliberation, the jury returned a complete defense verdict in favor of all three board members.
