Orlando Partners Michael Merrill and Scott Shelton received a complete defense verdict in Marion County involving a car accident.
The Defendant/Client was a commercial garbage hauling company whose truck was making a left turn when it collided head-on with Plaintiff’s vehicle. The impact pushed Plaintiff’s vehicle backwards approximately 30 feet and was totalled as a result of the accident.
Plaintiff, who was 72 years old and had no pre-incident complaints/treatment of orthopaedic issues, underwent treatment to his knee, neck, and back from numerous doctors over the course of five years and had a surgical recommendation from a neurosurgeon for his L4 – L5.
Defendants admitted liability for the accident but contested the cause/extent of Plaintiff’s injuries. Plaintiff asked the jury for approximately $630,000. After the jury deliberated for approximately 2.5 hours, they returned with a verdict awarding Plaintiff past medical expenses of only $3,335 (which was much lower than those incurred), no money for future meds, and a finding of no permanency.
