Jacksonville Partner Brian Aull and Miami Partner Gene Kissane recently won a defense verdict in Putnam County.
The case involved a rear-end vehicle accident where Brian and Gene, on behalf of their client, admitted fault for the accident. They defended the case by attacking causation and damages. By way of further background, the Plaintiff, approximately a 40 year member of the United States Army, was at a stoplight and he was rear-ended by the client that CSK represented. Following the accident, the Plaintiff was transported by EMS to the local emergency room. Thereafter, and over the course of multiple years, the Plaintiff underwent, among other things, 4 surgeries, including 2 surgical fusions. His medical bills exceeded $800,000.
The Plaintiff’s attorneys asked the jury to return a large verdict of millions of dollars.
The jury returned a complete defense verdict and found that our client’s admission of liability for the accident did not constitute a legal cause of damage.
