West Palm Beach Partners Barry Postman and Patrick Folley recently got a plaintiff to agree to drop their case for no money on the second day of trial.
The case involved an alleged breach of an employment agreement where the plaintiff was claiming her employer, an insurance company, violated her contract by improperly changing her position and thereafter improperly terminating her for cause. The case was litigated for over 4 years. The plaintiff sought monetary damages under the contract and over $500k in fees and costs.
On the second day of trial the plaintiff lawyer approached Barry asking about settlement and he promptly told the lawyer it was too late but that he could get his client to agree not to go after the plaintiff for fees and costs if the plaintiff dropped the claim with prejudice. The plaintiff agreed and the case was over. The client who was prepared to pay money to settle the case was thrilled.
