West Palm Beach Partner John Chiocca and Orlando Partner Scott Shelton recently received an excellent trial result in Seminole County against a national plaintiff firm.
The case involved a motorcycle versus commercial truck accident where our client hit the back of Plaintiff’s motorcycle while he was stopped at a red light which resulted in the motorcycle being totaled. EMT services were called to the scene where Plaintiff had positive complaints of pain before being transported to the emergency room. Plaintiff’s treatment continued where he eventually underwent surgery to his left shoulder and lower back. Plaintiff boarded approximately $210,000 in past medical expenses and also had a Life Care Plan.
During closing arguments, Plaintiff asked the jury for over $3,000,000. After approximately 3.5 hours, the jury returned a verdict awarding just over $94,000 for past medical expenses but did not award any money for future medical care or past / future pain and suffering.
