Jacksonville Partners, Jennifer Kass, Joseph Kissane, and Kurt Koehler obtained a favorable trial result last week in Gainesville in an automobile accident case. This case involved disputed liability in that Plaintiff originally testified his lights were off and it was not dark out on a two lane county road in Lake City in December at 6:30. Plaintiff later changed his testimony to that his lights were on and it was dusk out. Conversely, their client admitted to glancing at his cell phone to see a text from his father just before the accident.
While the jury determined Plaintiff was 10% at fault, Plaintiff’s claim for damages were based on an alleged aggravation of pre-existing degenerative condition in both the neck and back requiring pain management in epidurals and RFAs. Plaintiff dropped his past medical claim during the trial leaving only a future medical request and non-economic damages, should permanency be found, on the verdict form.
The request from Plaintiff to the jury was $1,867,000.00. The jury only awarded $280,000.00 for future medical damages and found no permanency.
