Tampa Partner, Howard Scholl, and Tampa Associate, Lowell Brown received an excellent civil trial result after defending an individual who made a left turn and struck a motorcyclist. This was a hard-fought trial that had to be stopped twice to conduct the depositions of 2 different doctors who appeared and offered surprise opinions.
Plaintiff, a 38-year-old male, had more than $479,000 in boardable medical expenses. The defense presented evidence Plaintiff was speeding and had surveillance of him at work but had to concede a knee injury was permanent after our CME doctor offered that opinion. Ultimately, Plaintiff asked the jury to find defendant fully at fault and award more than $6 million. After 5 hours of deliberation, the jury returned a verdict of 596,900 and found Plaintiff 22.5% at fault, for a total verdict of $462,875.00.
