Orlando Partners Mike Merrill and Scott Shelton recently received a favorable trial result in Orange County for an underinsured motorist claim on behalf of a well-known insurance carrier.
Plaintiff was rear-ended by another vehicle and immediately received treatment at the emergency room. She continued treatment afterwards and eventually underwent a two-level laminectomy to her lower back. Her problems did not resolve and she then underwent a fusion for the two-levels below her laminectomy. Plaintiff boarded approximately $175,000 in past medical expenses and asked for close to $1 million during closing. The defense did not call any witnesses during trial. After seven hours of deliberations, the jury returned a verdict awarding Plaintiff only her past medical expenses but found Plaintiff did not sustain a permanent injury and awarded nothing for pain and suffering. The verdict, which will be further reduced by collateral sources, was less then Defendant’s pre-trial offer and pending Proposal for Settlement.
