Tampa Partners, Michelle Bartels and Dan Shapiro, recently obtained a favorable trial verdict in Hillsborough County.
This was an admitted liability, side-swipe accident, where Plaintiff underwent cervical procedures and a lumbar laminectomy, and incurred medical expenses of $190,000, with claimed future medical expenses of $245,000. Plaintiff had no significant prior injuries or complaints of pain in the neck or low back.
Michelle and Dan argued that Plaintiff had a degenerative condition in his spine and that due to delayed onset of symptoms and complaints, the treatment obtained was not related to the accident. Plaintiff asked for almost $3M in closing. After 5.5 hours of deliberations, the jury returned a verdict of past medical expenses only.
