Orlando Partners Gary Lewis and Scott Shelton recently obtained a favorable verdict in a personal injury claim in Orange County, Orlando Florida.
Plaintiff alleged she was injured at home after stepping on a nail in the front of her house shortly after Defendant’s roof renovation was completed. Plaintiff further alleged Defendant was negligent in the clean up on the property after Plaintiff found numerous nails in her yard following the incident. Plaintiff reported to the doctor the following day where a puncture wound was found. Plaintiff continued to receive treatment and eventually underwent surgery to her food to repair a nerve following a positive nerve conduction study. Plaintiff sought to recover past medical bills, past / future pain and suffering, and requested the jury award her approximately $4.5 million. The jury returned a verdict finding Plaintiff 50% negligent and awarded only $12,000 in past medical expenses, $5,000 in past pain and suffering, and $0 for future pain and suffering. This was very close to what Defendant suggested during closing. Plaintiff’s net recovery was $8,500.00. Defendant did not call any witnesses and had an expired Proposal for Settlement for well above the amount of the judgment
