Pensacola Associate Jeremiah Monahan and Pensacola Partner Richard Fillmore recently obtained a final judgment in favor of both of its clients in an automobile negligence case based on res judicata.
More specifically, Defendants successfully argued Plaintiff’s claim was barred both by the prohibition against a party splitting causes of action as well as claim preclusion. In this case, the court held that a previously filed case filed by Plaintiff while pro se which was unsuccessfully litigated to its conclusion barred his later-filed case filed by counsel based on multiple forms of res judicata. The result was a Final Judgment in favor of both of CSK’s clients.
