Final Summary Judgment for Property Insurance Carrier

Bonita Springs Partner, Barbara Woodcock, recently secured final summary judgment for a property insurance carrier in Collier County. Plaintiffs alleged their property was damaged from Hurricane Irma in September 2017. Although Plaintiffs made repairs in 2017, they did not report the claim until almost three years later which was denied by the insurance carrier for late reporting and prejudice. The Court found Plaintiffs’ failure to provide prompt notice of the claim prejudiced the insurance carrier’s investigation and entered final summary judgment in favor of the property insurance carrier.
