Tampa Partner, Aaryn Fink Ledoux, has successfully secured a Final Summary Judgment in a Slip and Fall case in Hillsborough County.
At the time of the incident, the Plaintiff, a tenant at the complex, was walking his dog when he stepped off the sidewalk and into a grassy/wooded area within the community. The Plaintiff alleged that he slipped and fell in mud, which he claimed was caused or created by the apartment complex.
In defense, Ms. Ledoux argued that the grassy/wooded area was considered a landscaped area and, therefore, did not constitute an inherently dangerous condition that required a duty to warn. The court agreed with this argument and consequently entered a Final Summary Judgment in favor of our client.
