Orlando Partner, Scott A. Shelton, and Associate, Adam Stetson, won a Motion for Final Summary Judgment in Orange County in a premises liability case against her homeowners’ association. Plaintiff alleged she tripped and fell due to an alleged dangerous condition while walking on a paved walking path/trail located within her HOA. Plaintiff sustained numerous injuries which required surgery. Defendant argued the condition was not a dangerous condition, it was open and obvious, and it was discoverable through the exercise of due care. The Court agreed and Defendant’s motion was granted which will allow the Defendant to collect it fees and costs with an expired Proposal for Settlement.
