CSK Pensacola Partner Grayson Miller recently won a motion to dismiss with prejudice for CSK's client, a landlord, in a negligent shoot case. Our client landlord made two primary arguments. First, a landlord owes an extremely limited duty to its tenant and invitees of its tenant because the landlord necessarily turns control of the premises over to its tenant, and, in this case, Plaintiff failed to plead the appropriate limited duty (instead alleging a more generic premises liability claim). And second, this position was further bolstered by the subject Lease agreement which expressly disclaimed any obligation for the landlord to provide security for the premises.
