Orlando Partner, David Evelev, and Orlando Associate, TJ Monaghan, obtained a significant trial result in Osceola County on Friday. The case involved a vehicle-pedestrian accident captured on video which showed Defendant’s vehicle traveling at a high rate of speed, failing to stop at a stop sign, and striking Plaintiff who was pushing a shopping cart and throwing him several feet. The video was played repeatedly throughout trial over objection.
Plaintiff treated for over four years after the accident, including pain management treatment (10 injections to back, neck and hip) and hip surgery. There were recommendations for future surgery. At trial, Plaintiff boarded over $120,000.00 in past medical bills and a Life Care Plan for over $1,200,000. During Plaintiff’s closing, they asked for all of Plaintiff’s economic damages and about $4.5 million in non-economic damages.
The jury awarded the Plaintiff past medical expenses but only $30,000.00 in future medical expenses. Significantly, they found Plaintiff did not sustain a permanent injury and awarded no pain/suffering.
