Successful Verdict in First Party Insurance Case

In a notable victory in First Party Insurance litigation, Jacksonville Partner Heather Hatcher and Tampa Partner Lauren Kilgore have secured a highly Favorable Verdict for our client. The case involved damage to the Insured's home following a toilet overflow. Initially, the insurance company acknowledged the damage and paid $8,000 subsequently closing the file.

However, the Insured claimed that the cast-iron plumbing system beneath the house caused the damage, necessitating a complete tear-out and replacement, estimating the cost at $75,000. The insurance company argued that such extensive repairs were unnecessary and asserted that the proper repair would only cost $20,000.

To resolve the dispute, we filed a Proposal for Settlement (PFS) for $17,000, exclusive of fees, costs, and interest, followed by another PFS for $39,000. Ultimately, the jury awarded the exact amount our experts had calculated - $20,000.
