Orlando Partner, Stephanie McCoy, prevailed on summary judgment in a premises liability case against a grocery store in Volusia County, Florida. The Plaintiff alleged that she slipped and fell while shopping at the store due to water on the floor, resulting in right knee surgery and treatment for her neck, back and shoulder. The store video showed that the water was only on the floor for approximately ten minutes before the Plaintiff’s fall occurred. The defense argued that the Plaintiff could not establish that the store had actual or constructive notice of the water spill and that ten minutes was an insufficient length of time to impose liability on the store. The Court agreed and granted the Defendant’s Motion for Final Summary Judgment.
