Orlando Partner Jeffrey Partlow and Orlando Associate Savannah Duffy recently obtained a summary judgment in favor of their clients.
After purchasing a 70-year-old home on a tidal river in Volusia County, Plaintiffs uncovered structural damage to the flooring system during renovations. Plaintiffs then brought suit against the seller’s relator, buyer’s realtor, and the listing broker for the transaction for alleged violations of statutory duties under section 475.278, Florida Statutes, for failure to deal honestly and fairly; using skill, care, and diligence in the transaction; and disclosing all known facts that materially affect the value of the property and are not readily observable to the buyer.
Summary judgment was entered in favor of CSK’s clients because there was no evidence they violated the statutory duties or caused Plaintiffs any damage.
