Ft. Lauderdale partner, Jami Gursky, obtained final summary judgment on behalf of a sober home and Licensed Clinical Social Worker who were alleged to have negligently accepted, monitored and treated a resident who overdosed and died on the premises. Plaintiff claimed that the resident required a higher level of care, more frequent monitoring, and regular drug testing. Ms. Gursky argued that the Defendants did not owe or undertake a duty to “treat” the resident, breach the applicable standard of care, or contribute to the resident’s death. Summary judgment was awarded on all three independent grounds. Ms. Gursky was also successful in striking Plaintiff’s expert’s standard of care and causation opinions.
