In this auto accident liability trial, the defense admitted liability for the rear end accident. Plaintiff was a 35 year old Navy veteran with no prior orthopedic injuries.
In addition to an Emergency Room visit, conservative care and routine diagnostic studies, Plaintiff underwent cervical epidural injections, nerve blocks in the lumbar facets, disc replacement surgery at the C 4/5, and a partial discectomy-laminectomy at L5/S1. Past medical bills were $269,000 with projected future medical bills of $70,000 to $150,000.
In closing Plaintiff’s counsel suggested future pain and suffering of $10 per hour for the remaining 35 year life expectancy of the plaintiff, which amounts to more than $3 million. The defense recommended that the jury award 90 days of conservative care, amounting to $14,750. After three hours of deliberation, the jury awarded only $12,000.
