Trial WIn - First-Party Property - Brevard County

Tampa Partner Paydon Broeder, Orlando Partner Sade Oyinloye Jackson, and Associate Jennifer Pinto recently won a trial in Brevard County.

This was a first-party property trial in which Plaintiffs alleged the carrier breached the contract by failing to either repair their property or issue payment to repair the property. Defendant alleged that Plaintiffs were ineligible for the Managed Repair Program and otherwise paid all applicable sublimits pursuant to the policy.

After Plaintiff closed, the Judge granted directed verdict in favor of the carrier finding that the Plaintiffs were ineligible for the Managed Repair Program and that the carrier did not breach the policy. This was the carrier's first trial on this particular endorsement.
