Trip and Fall Defense Verdict

Orlando Partner, Melissa Crowley and Miami Partner, Gene Kissane, obtained a complete defense verdict following a five-day jury trial in Volusia County.

Plaintiff filed suit against Defendant, Daytona Beach’s oldest bar, after an employee allegedly tripped and fell over band equipment wires when delivering a sandwich to the band in the process of setting up.

Plaintiff alleged we failed to properly tape down the cord or warn Plaintiff of the cord on the ground. Plaintiff subsequently underwent a scope and total knee replacement as a result of the fall. Plaintiff’s counsel brought in a number of experts to prove his case, including a slip and fall expert, orthopedic surgeon, life care expert, and economist.

The defense argued nothing was dangerous about the band having a cord on the ground during set-up and the bar warned her via staff meetings not to go on the stage. Further, the surgeries were the result of pre-existing arthritis and osteoarthritis.

The jury was out less than an hour before returning a full defense verdict.
